This Privacy Policy explains how Bittersberg LLC ("Bittersberg," "we," "us," or "our") collects, uses, shares, and protects personal information when you visit bittersberg.com, place an order with us, or otherwise interact with our business.

Bittersberg LLC is the business responsible for the personal information described in this policy. For visitors in the European Economic Area or the United Kingdom, Bittersberg LLC is the data controller.

Bittersberg LLC is an independent retailer and distributor. We are not the manufacturer of the products we sell. Product manufacturers maintain their own separate privacy policies, and this policy does not cover their practices.

Information We Collect

Information you give us directly. When you place an order, create an account, apply for a wholesale account, sign up for emails, or contact us, we collect:

  • Name
  • Email address
  • Phone number
  • Billing and shipping address
  • Business name, business address, and website or social media handle (wholesale applicants only)
  • Order history and contents
  • Messages you send us

We do not store your full payment card number. Card payments are processed by Shopify and its payment processors, who handle that information under their own privacy policies.

Information collected automatically. When you use our site we collect device and usage data, including IP address, browser type and version, operating system, pages viewed, time spent on pages, referring URLs, and general location inferred from IP address. We collect this using cookies, pixels, tags, and similar technologies.

How We Use Your Information

  • To process, fulfill, and ship your orders
  • To communicate with you about orders, shipping, and customer service
  • To review and approve wholesale account applications
  • To send marketing emails, where you have not opted out
  • To operate, secure, and improve our website

Advertising and Analytics Partners

This section describes how we share information with advertising partners. Please read it carefully.

We work with third-party advertising and analytics companies to measure the performance of our advertising and to show you more relevant ads. To do this, we share certain personal information with these partners, including hashed (cryptographically scrambled) email addresses, hashed phone numbers, and other online identifiers. Our partners use this information to match you to their own account holders so that we can:

  • Show ads to people likely to be interested in our products
  • Avoid spending advertising budget showing ads to people who are already our customers
  • Measure whether our advertising actually results in sales

We do not sell your personal information for money. However, under California law, sharing personal information with advertising partners for cross-context behavioral advertising, as described above, may be considered a "sale" or "share." See "California Privacy Rights" below for how to opt out.

Cookies and Tracking

We use cookies and similar technologies for the following purposes:

  • Essential: to run the site, keep you signed in, hold your cart, and prevent fraud. These cannot be turned off.
  • Analytics: to understand how visitors use the site so we can improve it.
  • Advertising: to measure ad performance and show relevant ads.

Most browsers let you block or delete cookies through their settings. Blocking essential cookies may prevent parts of the site from working.

Our site does not currently respond to browser "Do Not Track" signals. We do honor Global Privacy Control (GPC) signals where required by law.

Your Choices

  • Marketing emails. Click "unsubscribe" in any marketing email, or email us at office@bittersberg.com. You will still receive transactional messages about orders you place.
  • Ad personalization. Opt out through the industry tools at optout.aboutads.info, optout.networkadvertising.org, or youronlinechoices.com. On mobile, use "Limit Ad Tracking" (iOS) or "Opt out of Ads Personalization" (Android). Note that these opt-outs are stored per browser and per device.
  • Removal from our advertising lists. Email office@bittersberg.com and we will remove you from customer lists we share with advertising partners.

California Privacy Rights

If you are a California resident, the California Consumer Privacy Act as amended by the CPRA gives you the right to:

  • Know what personal information we collect, use, disclose, and share
  • Request a copy of the personal information we hold about you
  • Request deletion of your personal information, subject to legal exceptions
  • Request correction of inaccurate personal information
  • Opt out of the sale or sharing of your personal information for cross-context behavioral advertising
  • Not be discriminated against for exercising these rights

In the past 12 months we have collected identifiers (name, email, phone, address, IP address), commercial information (purchase history), and internet activity information (site interactions). We have shared identifiers and internet activity information with advertising partners for cross-context behavioral advertising, and have disclosed identifiers and commercial information to service providers for business purposes.

We do not knowingly collect or share the personal information of consumers under 16 years of age. We do not use or disclose sensitive personal information for purposes requiring a right to limit.

To exercise any of these rights, including opting out of sharing for advertising, email office@bittersberg.com with the subject line "California Privacy Request," or call 512-527-4693. We will verify your identity before responding and will respond within 45 days. You may use an authorized agent, in which case we may ask for proof of authorization.

Residents of other US states with comprehensive privacy laws, including Colorado, Connecticut, Virginia, Texas, Oregon, and others, have similar rights. Use the same contact details above.

EEA and UK Rights

If you are located in the European Economic Area or the United Kingdom, you have the right to access, correct, delete, restrict, or object to our processing of your personal information, and the right to data portability. Where we rely on consent, you may withdraw it at any time.

We process personal information on the following legal bases: performance of a contract (to fulfill your orders), legitimate interests (to operate, secure, and improve our business), consent (for marketing and advertising cookies where required), and legal obligation.

Your information is processed in the United States. Where we transfer personal information out of the EEA or UK, we rely on appropriate safeguards such as Standard Contractual Clauses.

Data Retention

We keep order records for as long as needed to fulfill orders, handle returns and disputes, and meet tax, accounting, and legal recordkeeping obligations, typically seven years. Marketing contact information is kept until you unsubscribe or ask us to delete it. Analytics and advertising data is kept for shorter periods set by the relevant platform.

Security

We use commercially reasonable safeguards to protect your personal information, including encryption in transit and access controls. No method of transmission or storage is completely secure, so we cannot guarantee absolute security.

Children

Our site and products are intended for adults. We do not knowingly collect personal information from anyone under 13, and our products are not sold to anyone under the legal purchase age. If you believe a child has given us personal information, contact us at office@bittersberg.com and we will delete it.
